Privacy Policy — ABC and Me

Plain-language summary: ABC and Me stores all family photos and voice recordings only on your device. We do not collect, sell, or share your personal data. The only third-party services we use are Apple and RevenueCat for processing purchases. This Privacy Policy describes how ABC and Me (“the App,” “we,” “us,” or “our”), published by Jessica Magdziasz, handles information when you use our iOS application. It applies to all users worldwide and includes disclosures required under the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA) and the EU General Data Protection Regulation (GDPR).

  3. Children’s Privacy (COPPA) ABC and Me is designed for young children used under direct parental supervision. We do not knowingly collect personal information from children under 13. All personalization features are controlled exclusively by parents through a PIN-protected section. No data entered or generated by a child is transmitted off the device.

We comply with the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided personal information without parental consent, please contact us immediately and we will delete it promptly.

  1. Legal Basis for Processing (GDPR — EU/EEA/UK Users) If you are located in the European Union, European Economic Area, or United Kingdom, we process the limited personal data described above on the following legal bases:

Contractual necessity — processing purchase confirmation data to provide the content you purchased (Art. 6(1)(b) GDPR). Legitimate interests — storing app preferences locally so the App functions correctly (Art. 6(1)(f) GDPR). This does not override your rights. Consent — when you voluntarily add family photos or record your voice, you are actively providing that data. International transfers: Purchase receipt data processed by Apple and RevenueCat may be transferred to and stored in the United States. Both companies participate in frameworks that provide appropriate safeguards for cross-border data transfers (Standard Contractual Clauses / EU–US Data Privacy Framework where applicable). All other data remains on your device.

  1. Third-Party Services We use the following third-party services solely for purchase processing:

Apple App Store / StoreKit — handles all payment transactions. Apple Privacy Policy ↗ RevenueCat — manages subscription status and purchase receipts. RevenueCat Privacy Policy ↗ We do not use advertising networks, analytics SDKs, social media plugins, or any other third-party service. We do not sell, rent, trade, or otherwise share your personal information with any third party for commercial purposes.

  1. Your Rights — EU / GDPR If you are in the EU, EEA, or UK, you have the following rights regarding your personal data:

Right of access — request a copy of personal data we hold about you. Right to rectification — request correction of inaccurate data. Right to erasure (“right to be forgotten”) — request deletion of your data. Right to restriction of processing — request that we limit how we use your data. Right to data portability — receive your data in a structured, machine-readable format. Right to object — object to processing based on legitimate interests. Right to withdraw consent — withdraw consent at any time where processing is based on consent. Because virtually all data is stored only on your device, you can exercise most of these rights directly by editing or deleting data within the App, or by uninstalling the App. For any remaining requests, contact us at jmagdziasz@icloud.com.

  1. Your Rights — California (CCPA / CPRA) If you are a California resident, you have the following rights under the CCPA/CPRA:

7a. Right to Know You have the right to know what categories of personal information we collect, use, disclose, and sell. The categories we collect are listed in Section 1. We collect this information to operate the App. We do not sell or share personal information.

7b. Right to Delete You have the right to request deletion of personal information we have collected. Because all personal data is stored on your device, you can delete it directly within the App settings or by uninstalling the App. For purchase receipt data held by Apple or RevenueCat, please contact them directly.

7c. Right to Correct You have the right to request correction of inaccurate personal information. Contact us at jmagdziasz@icloud.com.

7d. Right to Opt Out of Sale or Sharing We do not sell or share your personal information with third parties for cross-context behavioral advertising or any commercial purpose. You do not need to opt out because no such sale or sharing occurs. 7e. Right to Limit Use of Sensitive Personal Information We do not use sensitive personal information (such as photos or voice recordings) for any purpose other than the App’s core functionality as described above.

7f. Right to Non-Discrimination We will not discriminate against you for exercising any of your CCPA/CPRA rights.

7g. Shine the Light (California Civil Code § 1798.83) We do not disclose personal information to third parties for their direct marketing purposes.

How to Submit a Request To exercise any California privacy right, contact us at jmagdziasz@icloud.com. We will respond within 45 days as required by law. We may need to verify your identity before processing your request.

  1. Data Retention All data stored by the App (photos, recordings, preferences) resides on your device and is retained until you delete it or uninstall the App. Purchase receipt data is retained by Apple and RevenueCat according to their own retention policies.

  2. Data Security We use iOS platform security features (AsyncStorage with device encryption, Expo SecureStore) to protect data stored on your device. No system can guarantee absolute security. We recommend keeping your device updated and protected with a passcode or biometric lock.

  3. Changes to This Policy We may update this Privacy Policy periodically. Material changes will be reflected by an updated “Last updated” date at the top of this page. We encourage you to review this policy whenever you have questions about our privacy practices.
